Terms of Service
Last updated: October 2026. These terms cover your use of this website and the basis on which Wynay ("Wynay", "we") provides design and development work. Using the site means you accept them. They're written to be readable — if anything is unclear, just ask.
1. About this site
This is an informational website for an independent digital studio. It describes services and lets you send an inquiry. It does not sell products, host online payments or provide user accounts; any such features would come with their own terms.
2. Inquiries
Submitting the contact form is a request to start a conversation, not a binding order. We'll reply to discuss your project; nothing is committed until a written proposal is agreed by both sides.
3. Service engagements
- Scope, price and timeline for any work are set out in a written proposal before work begins. Figures shown on this site are indicative starting points.
- Work proceeds in agreed milestones; each is reviewed and accepted before the next begins.
- Client-caused delays (missing content or feedback beyond agreed windows) extend timelines accordingly.
- On final payment, deliverable IP transfers to you, excluding pre-existing tools and open-source components, which you receive under their own licenses.
- Either party may end an engagement for material breach with written notice and a chance to remedy; accepted milestones remain payable.
4. Care & ongoing services
Where you engage an ongoing Care plan, its scope, price and billing cycle are confirmed in writing. You can cancel with notice as set out in that agreement; service continues through any period already paid for.
5. Acceptable use
Don't use this site for anything unlawful, deceptive or harmful. We may restrict access to protect the site or comply with the law.
6. Warranties & disclaimers
We perform work with professional skill and care. Specific commitments made in a signed proposal are honored as written. Otherwise this website and its content are provided "as is", and we disclaim implied warranties to the extent the law allows. We don't warrant uninterrupted operation of third-party platforms we build on.
7. Liability
To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the work giving rise to it, and neither party is liable for indirect or consequential damages. Nothing limits liability that can't legally be limited.
8. General
Wynay is an independent studio whose legal entity is being formed; the governing jurisdiction will be named here once incorporation is complete. If a provision is unenforceable, the rest stands. Material changes to these terms will be posted here with a new date. Questions: [email protected].
